LIABILITY AGREEMENT/ NO-WARRANTY ACKNOWLEDGEMENT

In consideration for the approval of my application to purchase a pistol, parts, accouterments, ammunition and/or components through CMP 1911, I hereby agree to:

  1. Waive any claim against the Corporation for the Promotion of Rifle Practice and Firearms Safety, Inc., CMP 1911, its directors, officers, employees, volunteers, agents and contractors (collectively, “CPRPFS”) for any personal injury, loss, damage or expense I might incur arising from the use of this pistol, parts, accouterments, ammunition and/or components, and
  2. Defend, indemnify and hold the CPRPFS harmless from any claim of a third party arising from the use of this pistol, parts, accouterments, ammunition and/or components including any expense incurred by the CPRPFS in defending, investigating or settling such a claim.

I agree with this agreement and legal issues arising from the sale of this pistol, parts, accouterments, ammunition and/or components to me shall be governed by the law of the United States; and if any provision of the agreement or its application to any person or circumstance is held invalid or unenforceable, the remainder of this agreement or the application of such provision to other persons or circumstances shall be unaffected. I further agree this agreement shall be binding upon my executors, administrators, trustees, personal representatives and assigns.

I also acknowledge the pistol which I am applying to purchase is a military surplus arm in used condition and is sold to me strictly “AS IS”, WITH A LIMITED LIFETIME WARRANTY. I understand:

  1. Unless otherwise noted, CMP surplus firearms undergo inspection, function firing, and are generally warranted against substantial material defects for a year. However, CMP strongly advises disassembly, cleaning, and inspection by a qualified individual before attempted firing.
  2. The use of ammunition that does not meet U.S. military standards in CMP firearms can be dangerous.

The limited lifetime warranty applies to the original purchaser of reworked surplus pistols sold by CMP and covers defects in materials and workmanship resulting directly from the rework process performed by CMP. This warranty is valid for the lifetime of the original purchaser and is non-transferable. Warranty applies to pistols in original configuration as sold. Click here for the warranty details.
